Privacy Policy (GDPR & CCPA)

1.1 Controller. The data controller for this website is DevCoreNetwork, registered at 48159 Kristiansandstrasse 123 B Münster, Germany. You can reach our privacy team at [email protected].

1.2 Data we collect. When you submit an inquiry form, email us, or call, we process: your name, email address, phone number (optional), company name, project details, and any information you voluntarily include. We also collect technical data such as IP address, browser type, and pages visited via server logs.

1.3 Purpose and legal basis. We process personal data to respond to inquiries (Art. 6(1)(b) GDPR — pre-contractual measures), to perform contracts (Art. 6(1)(b)), to satisfy legal accounting obligations (Art. 6(1)(c)), and — only with your consent — to send project updates (Art. 6(1)(a)). Server logs are processed for security and stability under our legitimate interest (Art. 6(1)(f)).

1.4 Retention. Inquiry data is retained for 24 months after the last contact. Contractual and invoice records are retained for 10 years as required by German commercial and tax law (§147 AO, §257 HGB).

1.5 Recipients. Data is processed by DevCoreNetwork staff and, where strictly necessary, by processors under Art. 28 GDPR data-processing agreements — including our EU-hosted email provider, hosting infrastructure, and Stripe for payment processing. We do not sell or rent personal data.

1.6 International transfers. Where a processor operates outside the EEA, transfers rely on EU Standard Contractual Clauses or an adequacy decision, supplemented by technical and organizational safeguards.

1.7 Your rights. Under GDPR you have the rights of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), data portability (Art. 20), and objection (Art. 21). You may withdraw consent at any time without affecting prior processing. You also have the right to lodge a complaint with a supervisory authority — for us, the Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen.

1.8 CCPA notice (California residents). We do not sell or share personal information as those terms are defined under the CCPA/CPRA. You may request access to, deletion of, or a copy of personal information we have collected about you, and may designate an authorized agent to do so, by emailing [email protected]. We will not discriminate against you for exercising these rights.

1.9 Automated decisions. We do not engage in profiling or solely automated decision-making that produces legal or similarly significant effects.

Terms of Service

2.1 Scope. These Terms govern all services provided by DevCoreNetwork (48159 Kristiansandstrasse 123 B Münster, Germany) including web application development, data pipeline engineering, integrations, consulting, and maintenance retainers. Individual projects are additionally governed by a signed statement of work (SOW); where the SOW conflicts with these Terms, the SOW prevails.

2.2 Proposals and acceptance. Prices, deliverables, and timelines quoted on our website or in proposals are binding for 30 days. A contract is formed upon the client's written acceptance or first payment, whichever occurs first.

2.3 Fees and payment. Unless the SOW states otherwise, fixed-price projects are invoiced 50% at kickoff and 50% at delivery. Payments are processed via Stripe; invoice amounts are due net 14 days from the invoice date. Late payments accrue statutory default interest (§288 BGB) plus a €40 recovery fee for consumers where applicable.

2.4 Client obligations. The client provides timely access to content, credentials, feedback, and decision-makers. Delays in client feedback extend delivery dates day-for-day. The client warrants that all materials supplied (copy, images, trademarks) do not infringe third-party rights.

2.5 Intellectual property. Upon full payment, DevCoreNetwork assigns all rights in the client-specific deliverables — source code, designs, and documentation — to the client worldwide and irrevocably. DevCoreNetwork retains rights to pre-existing tools, libraries, and know-how, and grants the client a perpetual, non-exclusive license to any such components embedded in the deliverables. Portfolio reference rights are reserved unless the SOW states otherwise.

2.6 Third-party services. Deliverables may rely on third-party platforms (hosting, payment providers, APIs). DevCoreNetwork is not liable for outages, pricing changes, or policy changes of such providers, but will use reasonable efforts to design resilient integrations.

2.7 Warranty. For 90 days after delivery we warrant that deliverables materially conform to the agreed specifications. We will correct reproducible defects within a reasonable time at no charge. Excluded are issues caused by unauthorized modifications, third-party updates outside our control, or misuse. This warranty does not limit statutory rights under §§ 634 ff. BGB.

2.8 Limitation of liability. DevCoreNetwork is liable without limitation for intent and gross negligence, for injury to life, body, or health, and as required by the Product Liability Act. For ordinary negligence, liability is limited to the breach of essential contractual duties, with foreseeable damages capped at the total fees paid under the relevant SOW in the prior 12 months.

2.9 Termination. Either party may terminate an ongoing SOW for convenience with 30 days' written notice unless a different notice period is agreed. DevCoreNetwork may terminate immediately if the client fails to cure a payment default within 14 days of written notice. Upon termination the client pays for all work performed to date.

2.10 Governing law. German substantive law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The courts of Münster, Germany have exclusive jurisdiction for merchants, legal entities under public law, and special funds under public law. Consumers may sue in any court competent under EU consumer law.

Cookie Policy

3.1 What cookies are. Cookies are small text files stored on your device when you visit devcorenetwork.com. Similar technologies (local storage, session storage) are covered by this policy as well.

3.2 Essential cookies. We strictly necessary cookies to operate this site:

  • cookie_accepted — local storage key that records your dismissal of our consent banner (persists on your device until cleared).
  • Session cookies required to deliver secure pages and protect forms against cross-site request forgery.

3.3 Analytics and marketing cookies. We currently do not set third-party analytics or advertising cookies on this website. If we introduce optional analytics in the future, we will request your consent via our banner before any non-essential cookie is placed, and this policy will be updated accordingly.

3.4 Third-party embeds. Our contact page embeds a Google Maps frame (maps.google.com). Loading that frame may cause Google to set cookies on your device under Google's own privacy policy. The map is loaded lazily; if you prefer not to interact with it, all address details are also available as text on the contact page.

3.5 Managing cookies. You can delete or block cookies through your browser settings at any time. Blocking essential cookies may degrade site functionality (for example, the consent banner may reappear on every visit). Browser guides: Chrome, Firefox, Safari, Edge — all support cookie controls under Privacy Settings.

3.6 Legal basis. Essential cookies are set under § 25 (2) No. 2 TDDDG (formerly § 25a TDDDG) / Art. 6(1)(f) GDPR — no consent is required for strictly necessary storage. Optional cookies would only be set after consent under § 25 (1) TDDDG / Art. 6(1)(a) GDPR.

3.7 Contact. Questions about cookies: [email protected], DevCoreNetwork, 48159 Kristiansandstrasse 123 B Münster, Germany.

Refund Policy

4.1 Fixed-price projects. Because our engagements involve custom, time-bound engineering work, fees for work already performed are non-refundable. If you cancel a project:

  • Before kickoff — full refund of any advance payment, less payment-processor fees already incurred.
  • After kickoff — the kickoff installment is non-refundable; any second installment becomes payable pro rata for work completed against the SOW milestones. If you have prepaid in full, we refund the portion attributable to work not yet performed, within 14 days of the termination notice.

4.2 Subscription retainers. Monthly maintenance retainers (e.g. the Managed Maintenance & SLA Retainer) can be cancelled at any time before the next billing date; the current month remains payable. We do not offer partial refunds for unused months once a billing cycle has started, except where required by law.

4.3 Defects and rework. If a deliverable materially deviates from the agreed specifications, notify us in writing within the 90-day warranty window described in §2.7. We will correct the deviation at no charge. If we fail to cure a substantial defect within a reasonable period set by you, you may reduce the price (minderung) or terminate the contract and claim damages in accordance with §§ 634 ff. BGB — your statutory rights are not affected by this policy.

4.4 Digital goods and one-off audits. Fixed-scope audits (security hardening, performance optimization, observability rollouts) are deliverable-based: once the written report has been delivered, the fee is non-refundable. If we cannot schedule and begin the audit within 30 days of purchase for reasons attributable to us, you may request a full refund.

4.5 Statutory withdrawal right (EU consumers). If you are a consumer concluding a service contract remotely, you have a 14-day right of withdrawal under §§ 312g, 355 BGB. Where you expressly request that work begin before the end of the withdrawal period, you owe us a proportional amount for services rendered until withdrawal. To withdraw, send an unequivocal statement to [email protected].

4.6 How to request a refund. Email [email protected] from the address used on the original order, include the invoice number and a brief description. Approved refunds are issued to the original payment method within 14 business days via Stripe.
